These Terms of Use govern your access to and use of relationalheart.com.

The terms “we,” “us,” and “our” refer to Cassandra Massey, JD, MA, LMFT #164709, doing business as Relational Heart (“Relational Heart”). Cassandra Massey is a California Licensed Marriage and Family Therapist.

The term “Site” refers to relationalheart.com and its associated webpages and features. The terms “you” and “your” refer to visitors and users of the Site.

By accessing or using the Site, you acknowledge that your use of the Site is subject to these Terms of Use.

WEBSITE INFORMATION ONLY

The information provided on this Site is intended for general educational and informational purposes. Content related to mental health, relationships, neurodivergence, parenting, psychotherapy, or other topics is general in nature and is not intended to provide individualized mental health, medical, legal, or other professional advice.

Information on this Site should not be used as a substitute for evaluation, diagnosis, treatment, or advice from a qualified professional who is familiar with your individual circumstances.

Although reasonable efforts are made to provide useful and accurate information, we do not guarantee that all information on the Site is complete, current, applicable to your circumstances, or free from error.

NO THERAPIST-CLIENT OR ATTORNEY-CLIENT RELATIONSHIP

Accessing or using this Site, submitting a contact form, sending an email, requesting a consultation, or requesting an appointment does not, by itself, establish a therapist-client relationship with Cassandra Massey or Relational Heart.

A therapist-client relationship is established only when Relational Heart has agreed to provide clinical services to you. Clinical services are subject to separate informed-consent, privacy, financial, telehealth, and other practice policies and agreements.

Although Cassandra Massey holds a law degree, Relational Heart does not provide legal services. Nothing on this Site creates an attorney-client relationship or constitutes legal advice.

PROFESSIONAL SERVICES

Relational Heart provides psychotherapy and related professional services only when appropriate and where Cassandra Massey is legally authorized to provide those services.

Information describing services on this Site is provided for general informational purposes and does not guarantee that any particular service will be available or appropriate for you.

Relational Heart may decline to establish a professional relationship based on availability, scope of practice, clinical appropriateness, conflicts of interest, or other legitimate professional considerations, subject to applicable law and professional obligations.

Once a therapist-client relationship has been established, the provision, scheduling, fees, cancellation, privacy, termination, and other terms of clinical services are governed by the applicable clinical agreements, policies, professional standards, and law—not by these Website Terms of Use.

EMERGENCIES AND URGENT COMMUNICATIONS

The Site, website contact forms, email, and consultation requests are not intended for emergency or crisis communications and may not be reviewed immediately.

Do not use the Site to seek emergency assistance or to communicate information requiring an immediate clinical response. If you are experiencing an emergency or believe that you or another person is in immediate danger, contact appropriate emergency services.

PRIVACY AND INFORMATION YOU SUBMIT

Your use of the Site is also subject to our Privacy Policy.

Information relating to clinical services may also be subject to additional privacy protections and any applicable Notice of Privacy Practices or other privacy notices provided by Relational Heart.

If you submit information through the Site, please limit the information you provide through general website contact forms to what is reasonably necessary to request information or services. Do not use general website forms to communicate urgent clinical information.

By submitting information through the Site, you represent that the information you provide is accurate to the best of your knowledge and that you have the right to provide it.

We do not claim ownership of information or materials you submit through the Site merely because you submitted them.

You may use the Site only for lawful purposes.

The Site may contain links to third-party websites, scheduling systems, payment processors, directories, resources, or other services that are not operated or controlled by Relational Heart.

Links are provided for convenience or informational purposes and do not necessarily constitute endorsement of the third party or its content, products, services, or policies.

Your use of third-party websites and services is governed by the terms and privacy practices of those third parties. Relational Heart is not responsible for the availability, security, accuracy, content, or practices of third-party websites or services.

WEBSITE AVAILABILITY AND CHANGES

We may modify, update, suspend, or discontinue any part of the Site at any time.

We do not guarantee that the Site will always be available, uninterrupted, secure, or free from technical errors, viruses, or other harmful components.

Information concerning services, availability, fees, policies, or other matters may change. Current clients should rely on the applicable clinical agreements and communications from Relational Heart regarding their individual services.

DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Site and its general informational content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

We do not warrant that use of the Site will produce any particular therapeutic, relational, health, legal, financial, or other outcome.

This disclaimer applies to the Site and its general informational content only. It does not alter or limit any professional duty or obligation arising from psychotherapy or other clinical services provided by Relational Heart.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Relational Heart shall not be liable for damages arising solely from your use of or inability to access the Site, temporary interruptions or technical errors, third-party interference, malicious software, or reliance on general informational content presented on the Site.

This limitation applies only to use of the Site and does not limit or exclude liability relating to psychotherapy or other professional services.

Nothing in these Terms excludes or limits any professional responsibility, legal duty, right, remedy, or liability that cannot lawfully be excluded or limited.

RELATIONSHIP TO CLINICAL AGREEMENTS

These Terms govern use of the Site only.

They do not replace, modify, or supersede any informed-consent agreement, Notice of Privacy Practices, Good Faith Estimate, financial policy, telehealth consent, group agreement, or other agreement or notice governing professional services.

If these Terms conflict with an agreement or policy governing clinical services, the applicable clinical agreement or policy controls with respect to those services.

GOVERNING LAW AND VENUE

These Terms of Use are governed by the laws of the State of California, without regard to conflict-of-law principles.

To the extent permitted by law, any legal proceeding arising solely from use of the Site shall be brought in a court of competent jurisdiction in Alameda County, California.

Nothing in these Terms restricts any right to contact or file a complaint with a licensing board, governmental agency, regulatory authority, or other entity, or any right or remedy that cannot lawfully be waived.

SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

NO WAIVER

A failure by Relational Heart to enforce any provision of these Terms does not constitute a waiver of that provision or of the right to enforce it in the future.

CHANGES TO THESE TERMS

We may update these Terms from time to time. The current version will be posted on this page with the date of the most recent update.

Changes apply prospectively to use of the Site after the updated Terms are posted and do not modify existing clinical agreements unless those agreements are separately amended in accordance with their terms and applicable law.
